Swiss Drug major Novartis AG has suffered a severe blow, with the Supreme Court rejecting its plea for an Indian patent for its cancer drug – Glivec. Dismissing the pharmaceutical major’s plea, the court held that modification of a known cancer-fighting drug cannot be considered as a patentable new invention.
Drug manufacturers are now free to make cheaper duplicates of Prezista, the Johnson & Johnson's HIV/AIDS, for sale in Africa and other less developed countries. J&J has allowed the manufacture of cheaper versions of the recently developed drug, provided high quality standards are maintained by drug makers.
